This document outlines the policy of Planet Cake regarding the use of its logo and product photos. Any use of any Planet Cake logo/product photos must be in accordance with this policy. As used in this memo, "logo/product photos" means not just Planet Cake's logos/photos, but also the names of its various products, as well as the names Funky Betty and www.planetcake.com.au.
Planet Cake's logo/product photos policy attempts to balance two competing interests: Planet Cake's need to ensure that its logo/product photos remain reliable indicators of quality and design excellence; and Planet Cake's desire to permit staff members and others that Planet Cake works with to discuss Planet Cake's products and to accurately describe their affiliation with Planet Cake. Striking a proper balance is a tricky situation that many organizations -- in particular those whose products are very popular such as Planet Cake wrestle with everyday.
Underlying Planet Cake's logo/product photos policy is the general law of Trademark. Logo/product photos exist to help consumers identify, and organizations publicize, the source of products. Some organizations make better products than others; over time, consumers begin to associate those organizations (and their logo/product photos) with quality. When such organizations permit others to place their logo/product photos on goods of lesser quality, they find that consumer trust evaporates quickly. That's the precise situation that Planet Cake seeks to avoid -- especially since, when it comes to intangible products like wedding cakes, trust is all consumers have to decide on.
Planet Cake encourages the use of its logo/product photos in marketing, fundraising and other publicity-related materials. That includes advertising stating that a person or organization is sponsoring or promoting Planet Cake products. Of course, any use of a Planet Cake logo/product photos is subject to the overarching requirement that you have prior permission from the Owners of Planet Cake to use it in the context desired. Planet Cake's logo/product photos are governed by the following basic guidelines which apply to almost any use of Planet Cake's logo/product photos in printed materials, including marketing, fundraising and other publicity-related materials, and websites:
So long as you don't do anything that might confuse visitors to your website, or that might violate the Overall Guidelines for Printed Materials, above, Planet Cake invites you to link to Planet Cake's website, including for the purpose of allowing your visitors to download our brochures etc. Planet Cake even provides the banners and buttons to facilitate the download of Planet Cake material:
The only exception to this policy is for site icons. If you plan to use a Planet Cake logo/product photos as a site icon, you need to request permission.
When it comes to Planet Cake's logo/product photos ("photos" for short), there are some cool things you can do and some cool things you can't do - at least not without asking Planet Cake.
You may make t-shirts, desktop wallpaper, or baseball caps with Planet Cake logos/cakes on them, though only for yourself and your friends (meaning people from whom you don't receive anything of value in return). You can't put the Planet Cake logo or cake photos on anything that you produce commercially -- at least not without receiving Planet Cake's permission.
Planet Cake has tried to make its logo/product photos policy as comprehensive as possible.
